A U.S. federal judge on Wednesday blocked the Trump administration from enforcing a new executive order seeking to restrict birthright citizenship, dealing another setback to President Donald Trump’s efforts to change the policy.
U.S. District Judge Deborah Boardman in Maryland issued a preliminary injunction after immigrant rights groups challenged the order. Boardman had previously blocked Trump’s original 2025 order seeking to limit birthright citizenship.
The U.S. Supreme Court ruled on 30 June that Trump’s first attempt to end birthright citizenship for some children born in the United States violated the citizenship clause of the 14th Amendment.
Trump signed a revised order on 6 August targeting so-called “birth tourism”, in which women travel to the United States to give birth so their children can obtain citizenship.
The order would also restrict citizenship in certain cases involving parents working for foreign governments, fraud or commercial transactions to obtain citizenship, and people classified as “alien enemies”.
Immigrant rights groups CASA and the Asylum Seeker Advocacy Project asked Boardman to block the revised order and protect the citizenship rights of affected children.
Boardman had expressed doubts about the order at a hearing last week, describing it as “unprecedented”.
Justice Department lawyers argued that the new order was narrower than Trump’s original directive and said the legal challenge was premature because federal agencies had yet to issue implementation guidance, expected by 5 September.
